The method is now issued to you, please carefully implement it. The number of applications for examination by the examiner may be determined on the basis of the need for review of production licenses for labor protection products in the region, and the application of the approved examiner shall be submitted to the Ministry of Labor Protection Product Production License before the end of July 1995.

The problems in the implementation of this measure should be reflected to us in a timely manner.

Attachment: Interim Measures for the Administration of the Examiner of Production Protection Licenses for Labor Protection Products

Article 1 These Measures are formulated for the purpose of strengthening the management of labor protection product production license examiners (hereinafter referred to as "examinators"), improving the quality of examiners' professional work, and ensuring the quality of certification examination work.

Article 2 The term "examinant" as used in these Measures refers to the staff member of the labor department that examines the conditions for obtaining (replacement) labor protection product production licenses.

Article 3 Inspectors shall be trained, assessed, and appointed by the Labor Product Protection Permit Office of the Ministry of Labor.

Article 4 examiners should have the following conditions:

(1) Familiar with the laws, regulations, policies and standards of the State regarding product quality supervision and management and labor protection products and their design and production;

(2) Familiar with the laws, regulations and policies of the State on the production license of industrial products and the production license of labor protection products, and be capable of proficiently performing the procedures for the acquisition and exchange of certificates in accordance with the "Implementation Rules for Production Licenses for Labor Protection Products". Strict review;

(3) Master the basic knowledge of quality management, quality assurance, and quality supervision, and relevant national standards. In the process of license review, routine supervision and management of labor protection product quality, and the sealing of product samples, strict compliance with the relevant standards can be achieved. Regulations and requirements;

(4) Familiar with the standards of labor protection products for the implementation of production license management, detailed implementation rules for quality inspections, production techniques, production equipment and testing equipment, which can meet the needs of certification review work;

(5) Strictly abide by the work discipline of the examiner, and perform due diligence on the review of labor protection product production licenses.

Article 5 In the labor protection product quality supervision and inspection institutions under the county level or above, the personnel engaged in the supervision, supervision or inspection of the quality of labor protection products, and those who meet the conditions of the examiner, are all acceptably appointed.

Article 6 To apply for the appointment of an examiner, the applicant shall submit an application. The employer shall, with the consent of the provincial labor administrative department, fill in the application form of the examiner (see Attachment 1) and submit it to the Labor Product Protection Permit Office of the Ministry of Labor. After the uniform organization of the labor protection product production license office organizes the training and assessment, it shall be appointed by the labor protection product production license office of the Ministry of Labor.

Article 7 The personnel to be hired shall be issued by the Ministry of Labor's Office of Labor Protection Product Production License as "Qualification Certificate for the Production License of Labor Protection Products of the Ministry of Labor" (see Appendix 2 for the format). When an inspector leaves the labor department or a related job, the labor certification product production license office of the Ministry of Labor shall withdraw the examiner's certificate.

Article 8 The examiner shall perform the following duties:

(1) Implementing laws, regulations, policies, and standards that govern national product quality supervision and labor protection product production license management;

(2) To participate in the review of the organization of the labor administrative department to bid for the conditions for obtaining (replacement) certificates for production licenses for labor protection products, and to earnestly complete the relevant tasks assigned by the Office of Production License of Labor Protection Products of the Ministry of Labor;

(3) to report to the relevant labor administrative department and labor license production license office of the Ministry of Labor the review and management of labor protection product production licenses;

(4) Having the right to criticize the falsification or phenomenon or act of illegality in the process of reviewing the labor protection product production license, and order it to correct or bring it to the relevant department.

Article 9 Inspectors shall earnestly study labor protection product standards and related technical knowledge, continuously improve their business capabilities, and receive business training every three years.

Article 10 An examiner may not participate in scientific research, production, or business activities of labor protection products for issuing licenses, and may not conduct paid consultations that are detrimental to impartiality.

Article 11 The examiner shall keep the technical data of the products, equipment and production processes of the enterprise under review properly, and shall not lose or compromise the information.

Article 12 The examiner shall abide by the "Code for Issuing Production License Personnel".

Article 13 Where there is outstanding achievement or outstanding contribution in the examination of the conditions for obtaining (replacement) certificates of enterprises, the production license office for labor protection products of the Ministry of Labor and the unit or relevant department concerned shall give appropriate rewards.

Article 14 Where it is found that the violation of the relevant provisions of these Measures during the examination of the conditions for obtaining (replacement) certificates of the enterprise, the Labor Permit Production Licensing Office of the Ministry of Labor has the right to cancel the employment of the labor protection product and recover the certificate of the examiner; if the circumstances are serious, Administrative sanctions shall be given by its administrative department or unit.

Article 15 When reviewing the conditions for obtaining (replacement) certificates for companies that apply for production licenses for labor protection products, three or more inspectors must attend and hold the certificates.

Article 16 The labor administrative department shall strengthen the management of examiners and maintain the relative stability of the examiners team.

Article 17 These Measures shall come into force as of the date of promulgation.
